EXCLUSION OF THE RIGHT OF WITHDRAWAL FOR MARKET-PRICE-DEPENDENT GOODS
Under Section 312g (2) No. 8 of the German Civil Code (BGB), there is no statutory right of withdrawal for contracts concerning goods or services whose price depends on fluctuations in the financial market over which the trader has no control and which may occur during the withdrawal period.
At GP METALLUM, this applies in particular to precious-metal products whose selling price depends directly or indirectly on current market prices for gold, silver, platinum or palladium.
There is therefore no statutory right of withdrawal for such goods, including where the contract is concluded at a distance.
EXCLUSION OF THE RIGHT OF WITHDRAWAL FOR PERSONALISED GOODS
There is also no statutory right of withdrawal for goods that are not prefabricated and whose production depends substantially on an individual choice or specification made by the consumer, or which are clearly tailored to the consumer's personal needs.
At GP METALLUM, this may in particular apply to personalised goods or goods produced according to individual customer specifications.
WITHDRAWAL INFORMATION FOR CONTRACTS FOR WHICH A RIGHT OF WITHDRAWAL EXISTS
The following information applies only where a statutory right of withdrawal exists for the relevant contract.
Right of withdrawal
You may withdraw from an eligible contract within fourteen days without giving any reason.
For a contract concerning the delivery of a single item, the period begins on the day on which you, or a person designated by you who is not the carrier, receives the goods.
Where several goods ordered as part of a single order are delivered separately, the period begins when the last item is received. Where goods are delivered in several partial shipments or pieces, the period begins when the final partial shipment or final piece is received.

clearly of your decision to withdraw from the contract. You may do so, for example, by letter or email. You may use the Model Withdrawal Form provided by GP METALLUM, but use of the form is not mandatory.
The deadline is met if your withdrawal statement is sent before the withdrawal period expires.
Electronic withdrawal function
Where a statutory right of withdrawal exists for a contract concluded through our online shop and the statutory requirements for an electronic withdrawal function apply, GP METALLUM makes this function available on the online user interface throughout the statutory withdrawal period.
The function is labelled “Withdraw from contract” or with another equivalent and unambiguous wording. After submitting the withdrawal electronically, you will promptly receive an acknowledgement on a durable medium, normally by email, containing the information required by law regarding receipt of your withdrawal statement.
Effects of an effective withdrawal
In the event of an effective withdrawal, we reimburse the payments received from you, including the cost of the least expensive standard delivery offered by us. Additional costs resulting from your choice of a more expensive delivery method are not reimbursed.
Reimbursement is made without undue delay and no later than fourteen days after we receive your withdrawal statement. Unless expressly agreed otherwise, we use the same payment method that you used for the original transaction. We do not charge you a fee for the reimbursement.
In the case of a sales contract, we may withhold reimbursement until the goods have been returned or until you provide evidence that you have sent them back, whichever occurs first.
The goods must be returned or handed over without undue delay and no later than fourteen days after you notify us of the withdrawal to:

The return deadline is met if the goods are dispatched before the fourteen-day period expires.
You bear the direct cost of returning the goods.
You are liable for diminished value only where it results from handling beyond what is necessary to examine the nature, characteristics and functioning of the goods.
ORDERS CONTAINING DIFFERENT TYPES OF GOODS
Where a contract contains both goods for which a statutory right of withdrawal exists and goods for which that right is excluded by law, the possibility of withdrawal for each item is determined by the applicable statutory provisions.
